River Rental Terms & Conditions Thank you for choosing to stay at our riverfront property (“the Property”). We appreciate your cooperation in following these Terms and Conditions. By booking and/or occupying the Property, you acknowledge that you have read, understood, and agree to adhere to these terms. --- 1. Booking & Payment 1. Reservation Confirmation: A reservation is considered confirmed upon receipt of payment and acknowledgment of these Terms & Conditions. 2. Payment: Payment must be made in full prior to check‐in, unless otherwise arranged in writing. 3. Security Deposit: We may collect a refundable security deposit to cover any damages or policy violations. The deposit will be returned within 1 day of check‐out, provided there are no damages or charges outstanding. --- 2. Cancellation & Refunds 1. Cancellation Policy: • Cancellations made at least 30 days before check‐in will receive a full refund. • Cancellations after this period may be subject to partial or no refund, depending on the circumstances. 2. No‐Show Policy: Failure to arrive by one day after reservation start date without prior notice will be treated as a last‐minute cancellation. --- 3. Check‐In & Check‐Out 1. Check‐In Time: 4:00 PM 2. Check‐Out Time: 11:00 AM 3. Early Check‐In/Late Check‐Out: Requests should be made in advance and may incur additional fees or may not be possible if there are same‐day bookings. --- 4. Occupancy & Guest Conduct 1. Maximum Occupancy: The total number of guests (adults + children) must not exceed 10. Any additional guest beyond this limit may result in immediate eviction or additional charges. 2. Minimum Age: The primary guest making the reservation must be at least 21 years old, unless otherwise agreed upon in writing. 3. No Unregistered Guests: Only the guests listed in the reservation are permitted on the Property. 4. Noise Level: Quiet hours are from 10 PM to 7 AM. Excessive noise or disturbances may result in eviction without refund. 5. Events & Parties: Large gatherings, events, or parties are strictly prohibited unless prior written permission is granted. --- 5. Property Use & River Safety 1. River Access: Guests use the river and any associated docks, piers, or watercraft at their own risk. 2. Life Jackets: We strongly recommend wearing Coast Guard–approved life jackets when boating, kayaking, or swimming. Life jackets are provided on premises. 3. Child Supervision: Children must be supervised at all times near or in the water. 4. Water Conditions: Check local river conditions, currents, and tides. The host is not responsible for injuries or accidents that occur due to water activities. --- 6. House Rules 1. Smoking: Smoking is only permitted in designated outdoor areas. Violation of this rule may result in additional cleaning fees and/or eviction. 2. Pets: Pets are allowed with prior approval and additional fees. Guests must clean up after pets and ensure they do not disturb neighbors or cause damage. 3. Damages & Breakages: Guests are financially responsible for any damages, breakages, or loss caused to the Property during their stay. 4. Cleanliness: Please maintain the cleanliness of the Property and discard trash in the designated containers. 5. Septic System: If applicable, do not flush sanitary products or other items that could clog plumbing or septic tanks. Only toilet paper may be flushed. --- 7. Maintenance & Repairs 1. Property Condition: The Property is inspected prior to check‐in to ensure it is clean and functioning. 2. Reporting Issues: Notify the host immediately if something is not working or if maintenance is needed. We will make reasonable efforts to resolve the issue promptly. 3. Emergency Repairs: In the event of an emergency (e.g., water leak, power outage), contact the host at 978-604-0522 immediately. --- 8. Liability & Indemnification 1. Assumption of Risk: Guests understand that staying near a river involves certain inherent risks (e.g., slippery surfaces, variable water conditions). By choosing to stay, guests assume all risks related to water activities, outdoor hazards, or natural surroundings. 2. Release of Liability: To the fullest extent permitted by law, the host(s) shall not be liable for any accidents, injuries, illness, loss, theft, or damage to persons or property. 3. Indemnification: Guests agree to defend, indemnify, and hold harmless the host(s) from all claims, disputes, litigation, judgments, costs, and attorney fees resulting from any breach of these Terms & Conditions or any harm or injury that occurs on the Property during their stay. --- 9. Termination The host reserves the right to terminate the rental and evict guests if they violate these Terms & Conditions or engage in unlawful activities. In such cases, no refunds will be issued. --- 10. Governing Law & Dispute Resolution These Terms & Conditions shall be governed by the laws of Massachusetts, Essex County. Any disputes arising from these terms shall be resolved in the courts of Massachusetts. --- 11.
