Atlantic Vacation Homes Terms & Conditions

Updated October 2026

These Terms & Conditions (“Terms”) apply to reservations made directly with Atlantic Vacation Homes, operated by AVH Realty, Inc. (“Atlantic Vacation Homes,” “AVH Realty,” “we,” “us,” or “our”), including reservations made through our website.

By making a reservation and accepting these Terms during checkout, you agree to the conditions below. Your reservation may also be subject to a separate Rental Agreement, property-specific rules, and other terms provided in connection with your stay.

Reservations made through third-party platforms such as Airbnb or Vrbo may also be subject to the terms, payment requirements, and cancellation policies of those platforms.

1. Reservations and Guest Eligibility

The person making the reservation must be at least 21 years old and must occupy the rental property for the duration of the reservation.

Reservations are subject to the occupancy limits, minimum-stay requirements, parking limits, availability, rates, and property-specific restrictions displayed at the time of booking. Minimum-stay requirements vary by property and dates.

The primary guest is responsible for the conduct of all members of their party and all visitors to the property. Atlantic Vacation Homes properties are intended for temporary residential vacation use only.

2. Rental Agreement

Guests booking directly with Atlantic Vacation Homes may be required to complete and electronically sign a separate Rental Agreement following booking. The Rental Agreement contains additional terms specific to the reservation and stay, including the property, reservation dates, occupancy, charges, property rules, damage responsibilities, and other guest obligations.

Guests are responsible for reviewing and completing the Rental Agreement when requested by Atlantic Vacation Homes. Atlantic Vacation Homes reserves the right to require a completed Rental Agreement before allowing occupancy of the property.

If there is a conflict between these Terms and a property-specific Rental Agreement concerning the guest’s stay, the Rental Agreement will control with respect to that reservation.

3. Rates, Taxes and Fees

Rental rates are based on the property, dates, length of stay, occupancy, and other applicable booking conditions.

Applicable taxes and fees are shown during the booking process and may include occupancy taxes, a Damage Fee, Guest Services Fee, pet fees, optional travel insurance, and other charges applicable to the reservation.

The Guest Services Fee supports guest services, features, amenities, and related services provided in connection with Atlantic Vacation Homes reservations. Its refundability is governed by the cancellation policy in Section 6.

Government-imposed taxes are collected as required by applicable law.

4. Payment

For direct reservations, Atlantic Vacation Homes generally requires 50% of the total booking amount, including applicable taxes and fees, at the time of booking. The remaining balance is due 60 days before arrival. For reservations made within 60 days of arrival, the full amount may be due at the time of booking.

Atlantic Vacation Homes accepts approved forms of payment including credit card, check, e-check, and cash, subject to the payment options available for the particular reservation.

When a balance remains due, Atlantic Vacation Homes may automatically charge the payment method on file on or around the applicable due date. If a payment is declined or cannot be processed, Atlantic Vacation Homes will attempt to contact the guest to resolve the outstanding balance. The guest remains responsible for ensuring that all required payments are made when due. Failure to resolve an outstanding balance may result in cancellation of the reservation.

5. Pricing and Booking Errors

Atlantic Vacation Homes makes reasonable efforts to ensure that property rates, availability, taxes, fees, and other reservation information are accurate. Occasionally, an obvious pricing, availability, technical, typographical, or system error may occur.

Atlantic Vacation Homes reserves the right to correct such errors. If an error materially affects a reservation that has already been made, Atlantic Vacation Homes will contact the guest and provide appropriate options, which may include accepting corrected reservation terms or cancelling the affected reservation and receiving a refund of amounts paid to Atlantic Vacation Homes for that reservation.

6. Cancellation Policy

For reservations made directly with Atlantic Vacation Homes: — 14 or more days before arrival: Full refund of all amounts paid. — 7 to 14 days before arrival: 50% of rent refunded. The treatment of other charges during this cancellation window will be governed by the reservation terms and applicable Atlantic Vacation Homes policy. — Less than 7 days before arrival: All monies paid are non-refundable. — 24-hour grace period: A booking is fully refundable if cancelled within 24 hours of booking, provided the booking was made at least 14 days before arrival.

Reservations made through Airbnb, Vrbo, Booking.com, or another third-party booking platform are subject to the cancellation policy applicable to that platform and reservation.

7. Changes to a Reservation

All reservation change requests must be submitted to Atlantic Vacation Homes in writing and are subject to availability and approval.

Changing to a different property within 14 days of arrival is treated as a cancellation of the original reservation and a new booking.

Removing nights from an existing reservation is considered a cancellation of those nights. In either case, the applicable cancellation policy applies.

If Atlantic Vacation Homes approves a change to reservation dates, Atlantic Vacation Homes may charge a $100 change fee, plus applicable tax, in addition to any change in the base rental rate, taxes, or other charges.

8. Travel Insurance

Atlantic Vacation Homes may offer guests the option to purchase travel insurance through a third-party insurance provider. Travel insurance is optional and is governed entirely by the policy, coverage limitations, exclusions, and terms issued by the insurance provider.

Guests are responsible for reviewing the insurance policy and determining whether the coverage is appropriate for their needs.

Atlantic Vacation Homes does not determine whether a particular event or claim is covered by the insurance policy.

9. Occupancy, Parking and Use of the Property

Each property has maximum occupancy and parking limits established by Atlantic Vacation Homes, the property owner, and/or applicable regulations.

Guests may not exceed the stated overnight occupancy without prior written approval.

Children count toward occupancy except children under two years of age. Campers or motor homes may not be parked at the rental property for the purpose of creating additional sleeping capacity. Other arrangements intended to exceed the property’s permitted sleeping capacity are not allowed unless expressly approved by Atlantic Vacation Homes.

Properties may only be used for lawful residential vacation purposes. Conduct that is unlawful, dangerous, disruptive, creates a nuisance, damages the property, materially interferes with neighbors, or violates applicable property rules is prohibited.

Guests and visitors are expected to respect the needs, rights, and privacy of neighbors at all times.

10. Parties, Gatherings, Events and Fireworks

Parties, gatherings, or events exceeding the property’s permitted occupancy are not allowed unless Atlantic Vacation Homes has provided prior written approval and the activity is permitted by applicable local regulations. Additional fees or requirements may apply.

Unauthorized parties or events may result in additional charges, fines, termination of occupancy, or other action permitted under the Rental Agreement and applicable law.

Fireworks are illegal in Massachusetts and may not be launched or used at an Atlantic Vacation Homes rental property.

11. Pets

Pets are permitted only at properties designated as pet-friendly and only with prior approval from Atlantic Vacation Homes where required. Applicable pet fees and property-specific pet rules must be followed.

Guests are responsible for their pets and for any damage, additional cleaning, pest treatment, waste removal, or other costs resulting from a pet brought onto the property. Approved pets must be properly supervised and handled in accordance with applicable local laws and property rules.

Pets may not be placed on furniture or beds unless Atlantic Vacation Homes expressly states otherwise.

Guests may be charged a minimum of $250 for pet-related damage or cleaning of pet waste, with additional amounts charged when actual costs exceed that amount.

Unauthorized pets may result in additional charges.

12. Check-In and Check-Out

Unless otherwise approved by Atlantic Vacation Homes, check-in is after 4:00 PM and check-out is by 10:00 AM so the property can be prepared for arriving guests.

Early arrival or late departure requires prior explicit approval from Atlantic Vacation Homes. A guest who arrives before 4:00 PM or fails to depart by 10:00 AM without approval may be charged a minimum fee of $75, plus applicable tax.

Guests must follow the property’s arrival and departure instructions, including instructions regarding access, keys, trash, dishes, and the general condition of the home.

13. Property Condition, Cleaning and Trash

Atlantic Vacation Homes will arrange for the property to be prepared and cleaned before guest arrival. Guests agree to leave the property reasonably neat and tidy, with dishes and cookware washed and put away and trash and recyclables handled as directed.

If extraordinary cleaning is required after departure, Atlantic Vacation Homes may charge a minimum Excess Cleaning Fee of $250. If excessive trash is left at the property, Atlantic Vacation Homes may charge a minimum Excess Trash Fee of $50. Additional amounts may be charged where the actual cost reasonably exceeds the applicable minimum.

Guests should promptly notify Atlantic Vacation Homes of any significant damage, maintenance issue, or unsafe condition discovered during their stay.

14. Damage Fee and Guest Responsibility

Atlantic Vacation Homes generally charges a non-refundable Damage Fee on short-term reservations. The Damage Fee provides limited protection for qualifying accidental physical damage to the rental property, subject to the terms and exclusions stated in the Rental Agreement.

Unless otherwise stated for the reservation, the Damage Fee covers qualifying accidental damage up to a maximum of 10 times the amount of the Damage Fee. For example, a $100 Damage Fee provides up to $1,000 of qualifying accidental-damage protection.

Guests must report any loss or damage to Atlantic Vacation Homes within 24 hours after it occurs. Damage not reported as required may not qualify for protection under the Damage Fee.

The Damage Fee does not eliminate the guest’s responsibility for damage that exceeds the applicable limit or is excluded under the Rental Agreement, including intentional damage, gross negligence or willful conduct, normal wear and tear, pet or animal damage, excessive cleaning, or damage to property owned by or brought to the premises by the guest.

Atlantic Vacation Homes reserves the right to charge the guest for amounts for which the guest is responsible under the Rental Agreement, including reasonable repair, replacement, remediation, or collection costs where applicable.

15. Security Deposits

Atlantic Vacation Homes generally does not collect a traditional security deposit for rentals of less than 90 days. Atlantic Vacation Homes reserves the right to require a security deposit for a particular property, reservation, length of stay, or other circumstance. Any applicable security deposit will be disclosed in connection with the reservation.

16. Smoking and Vaping

Smoking and vaping of any kind are prohibited in, on, or around Atlantic Vacation Homes rental properties unless Atlantic Vacation Homes expressly states otherwise in writing.

If smoking or vaping is found to have occurred in violation of this policy, the guest may be charged a minimum fee of $500, with additional amounts charged where reasonably necessary for cleaning, remediation, odor removal, or damage.

17. Furnishings and Property Amenities

Atlantic Vacation Homes rental properties are privately owned residential homes. Furnishings, layouts, features, equipment, and amenities vary by property. Guests should review the listing and property-specific amenities before booking.

Rental homes are generally furnished and equipped for residential vacation use. Specific furnishings and amenities may vary and are subject to the individual property listing and Rental Agreement.

While Atlantic Vacation Homes makes reasonable efforts to maintain accurate property information, furnishings, decor, equipment, or amenities may occasionally be replaced, changed, unavailable, or temporarily out of service.

Guests may not rearrange furniture without permission.

18. Maintenance, Utilities and Equipment

Items and equipment in rental homes are furnished by the property owner and are expected to be in working order. Equipment, appliances, utilities, internet service, air conditioning, heating, televisions, recreational equipment, and other amenities may occasionally malfunction or experience interruptions.

Guests should report problems promptly. Atlantic Vacation Homes will use reasonable efforts to arrange timely repairs or assistance but cannot guarantee that every issue can be resolved immediately.

A malfunction or temporary interruption does not automatically entitle a guest to a refund or cancellation, subject to applicable law and the circumstances involved.

19. Noise, Construction, Traffic and Circumstances Outside Atlantic Vacation Homes’s Control

Atlantic Vacation Homes cannot control neighboring properties, construction projects, road work, traffic, insects, community activity, weather conditions, utility interruptions, or other external circumstances outside Atlantic Vacation Homes’s reasonable control.

Such circumstances do not automatically qualify a reservation for a refund, discount, property substitution, or cancellation. Nothing in these Terms limits rights that cannot legally be waived.

20. Property Unavailability

If the reserved property becomes unavailable for the agreed reservation dates, Atlantic Vacation Homes may offer a comparable alternative property. If a suitable alternative cannot be provided or accepted, Atlantic Vacation Homes may cancel the affected reservation and refund payments made for that reservation.

21. Access to the Property

Atlantic Vacation Homes, the property owner, maintenance personnel, or authorized representatives may enter the property with reasonable notice when necessary for inspection, maintenance, repair, or other legitimate property-management purposes.

In an emergency, or where immediate access is reasonably necessary to protect a person or the property from harm, authorized persons may enter without prior notice.

22. Guest Safety and Assumption of Risk

Vacation rental properties may contain features commonly associated with residential and coastal homes, including stairs, decks, docks, pools, waterfront areas, rocks, cliffs, sea walls, changing tides, currents, boat traffic, channels, sandbars, outdoor equipment, and other natural or constructed features.

Guests are responsible for using the property and its amenities safely and appropriately. Swimming, boating, kayaking, use of pools, docks, waterfront areas, recreational equipment, and similar activities involve inherent risks. Guests and their visitors use such facilities and equipment at their own risk, subject to applicable law.

No running, rough play, or jumping from pool decks, sea walls, stairs, docks, ramps, or rocks is permitted. Where Atlantic Vacation Homes boating equipment is provided, life jackets must be used as required by Atlantic Vacation Homes instructions and applicable law.

Children must be appropriately supervised by a responsible adult at all times, particularly around water, pools, stairs, decks, docks, rocks, sandbars, roads, and outdoor areas. Guests must comply with all property-specific safety instructions.

23. Personal Property, Mail and Items Left Behind

Guests are responsible for their personal belongings during their stay. Atlantic Vacation Homes is not responsible for lost, stolen, damaged, or forgotten personal property except to the extent responsibility cannot legally be excluded.

Atlantic Vacation Homes will make reasonable efforts to recover valuable items reported as left behind and make them available for pickup or mailing. Guests are responsible for postage, shipping, and related return costs.

Guests should not have mail or packages delivered directly to a rental property unless arrangements have been made with Atlantic Vacation Homes. Atlantic Vacation Homes is not responsible for lost mail or packages sent to the property.

24. Telephone and Connectivity

Telephone and cellular service vary by property and location. Some homes may not have landline telephone service, and cellular coverage may be limited in certain areas. Guests should plan accordingly and may use Wi-Fi calling where available.

25. Violation of Terms

Material violation of these Terms, the Rental Agreement, applicable law, occupancy or parking restrictions, or property rules may result in additional charges and, where appropriate, termination of the guest’s right to occupy the property.

No refund will be due solely because occupancy is terminated as a result of the guest’s material violation, except where otherwise required by law.

26. Third-Party Booking Platforms

Reservations made through third-party platforms may be subject to additional or different terms imposed by the applicable platform. Where a platform controls payment processing, cancellation terms, refunds, or other aspects of a reservation, the applicable platform terms will govern those matters.

Guests should review the terms presented by the platform when booking.

27. Electronic Communications and Acceptance

By completing a reservation electronically, guests consent to receiving reservation-related communications electronically, including confirmations, Rental Agreements, payment notices, arrival information, property instructions, and other communications relating to their stay.

Checking the box indicating acceptance of these Terms during checkout constitutes electronic acceptance of these Terms.

Reservation-related text messages may be sent using the telephone number provided by the guest. Message and data rates may apply and message frequency may vary. Marketing communications are subject to separate consent and applicable preferences.

28. Privacy

Personal information collected in connection with reservations and guest services is handled in accordance with the Atlantic Vacation Homes Privacy Policy.

29. Dispute Resolution and Governing Law

These Terms and direct reservations with Atlantic Vacation Homes are governed by the laws of the Commonwealth of Massachusetts, without regard to applicable conflict-of-law principles.

The Rental Agreement may contain additional dispute-resolution requirements, including binding arbitration and provisions concerning legal fees and costs. Where applicable, guests agree to follow the dispute-resolution process contained in their Rental Agreement.

Nothing in these Terms limits any rights or remedies that cannot lawfully be waived.

30. Changes to These Terms

Atlantic Vacation Homes may update these Terms from time to time to reflect changes in its operations, policies, services, or legal requirements.

The Terms applicable to a reservation will generally be those presented and accepted in connection with that reservation. Changes made after a reservation is completed will not retroactively materially alter the guest’s agreed reservation terms unless required by law or agreed to by the guest.
